Minneapolis Council Clearview Aihatmakertechcrunch – The City Council of Minneapolis, Minnesota unanimously approved an ordinance banning the use of facial recognition, including Clearview AI’s software, by its police department. This is significant because there are currently no laws in the United States specifically prohibiting law enforcement from using facial recognition software.

This ordinance is not permanent, however. Lawmakers must come up with a way to permanently ban these tools before January 1st 2020 in order for it to become law without being vetoed by Mayor Jacob Frey.

Facial recognition software, most commonly used by law enforcement, has been compared to an “advanced surveillance tool for the 21st Century.” Facial recognition technology is a useful tool for law enforcement to identify people with whom they are dealing and help prevent crime, according to Clearview AI’s Chief Executive Officer, Gregg Hurwitz. “There is a place and time for facial recognition technology in the public sector,” said Hurwitz.

Clearview AI’s technology has received mixed reviews from the public. Some citizens are supportive of the technology while others have voiced concerns that it infringes on their privacy. Many police departments have been using this technology to make sure those who have outstanding warrants are not evading capture and to cross reference new faces with old crimes.

The only law that prohibits a government agency from using this type of software is California’s new privacy law, which goes into effect on January 1st, 2020.

One of the authors of the ordinance, Councilman Cam Gordon, has agreed that this is a way to keep technology like this in check. This will help communities decide how they want to be policed and help ensure that they are not being tracked without their knowledge or consent.

The public was invited to weigh in on proposed changes to the initial draft of the ordinance. The revisions were presented at a meeting on May 1st. Many members of the public were supportive of the changes, however, they requested a repeal at the end of the two-year prohibition.

The City Council suggested the possibility of allowing agencies to use this technology for emergency purposes. Councilman Andrew Johnson said that if a crime is being committed, he would like to see that law enforcement could use this technology for emergency purposes. However, it was not specified what could be considered an emergency circumstance.

This ordinance will likely face some challenges as it moves forward. The city attorney’s office is examining the ordinance to determine if there are any flaws. They expect to make a recommendation on whether the ordinance should be passed after a 30-day public review.
