Is It Time For Divorce? What to Expect From the Divorce Process

Couples can choose to separate on their own or they may request that the court formally issues a legal separation in some states. Regardless of how you go about the separation, it is important to know that separation is not the same thing as divorce.

While a divorce permanently ends your marriage, during a separation a couple is still legally married until one asks for a divorce formally. In some states, the court may require that you separate as a couple before allowing the divorce process to begin or end. There are some states that do not require that couples live separately before filing for a divorce.

However, in many cases, living together once a divorce request has been submitted by a party is not a wise option. Each state has a different definition and requirement for the separation stage. While some states require that the couple lives in separate homes, other states allow the couple to live in the same home as long as they refrain from sexual relations.

Filing for Divorce

Once you have decided that divorce is the best decision for you as a couple and you have figured out your separation plans, you can then work to file a divorce petition. This step initiates the legal process of your divorce. You should make sure you’re adhering to the separation regulations for your state to make sure your request is not rejected.

The spouse that is requesting the divorce will need to turn in the necessary paperwork to file. This paperwork will include legal information for both spouses, the legal grounds for the divorce, as well as any information about your children if you have any. Request regarding property division, alimony, or child custody and support will also need to be included in this paperwork.
